Requests under the Freedom of Information Act 2000 and the Environmental Information
Regulations 2004
As the above title suggests this request is made under both the Freedom of Information Act 2000
and the Environmental Information Regulations 2004. I request that East Herts District Council
(EHDC) provides me with copies of all files, records, letters, emails, records of telephone calls,
correspondence and documents relating to all complaints received, investigations, enforcement
actions and appeals relating to unlawful development or breaches of planning condition or
allegations thereof on land directly east of Church End Farmhouse, Church End, Little Hadham,
SG11 2DY between 1/10/2018 and 16/01/2019 given EHDC reference E/18/0365/ENF.

The only withheld information is personal data redacted from the files provided as required by the Data Protection Act of 2018

Please state why there are no file notes or other records stating the date, method of communication and details of any complaints received.

The date of the initial complaint can be seen in the file email 4 showing a date of 28/11/18 with the text beginning "I thought I should bring to your attention"

Please state why there are no file notes or other records showing the current status of the investigation

Current Status of the investigation is ongoing. There are no other file notes the document provided is the only file note at this time

The Emails provided are all emails held in regard to the case some contain duplicate data and email trails but are to or from different sources 

Please state the legal authority that you rely upon for having redacted details from the initial complaint of a breach of planning control made by email on 28th November 2018.

The Data Protection Act 2018 does not allow the publication of personal details all redaction was of names, email or telephone numbers. No information had been withheld

Given the incomplete records released please REVIEW your decision and processing of my original request. I understand that statute requires you to complete your review within 20 working days after which I am able to take any complaint to the office of the Information Commissioner.

In reviewing the data released The Freedom of Information Officer consulted with the Head of planning and with the legal services manager. It was the findings of the review that:

No further data exists in relation to this case

Planning have provided all data that exists at this time in relation to this case, no files have been withheld.

All redacted data is names, email addresses telephone numbers or other personal data that would normally be withheld as part of a freedom of information request.

 

As a result of these findings the council maintains that all data available at the time has been released and at the time of the conclusion of this review no other data has been created nor has there been any updates to the existing data.
