We have been advised by Datchworth Parish Council  to contact EHC to address our FOI request, as Cllr  has quoted

"“we have taken advice and the request is said to be unreasonable however, if you need more clarification on the situation contact XXXX or EHC” - 

As per the response from XXX Cllr. clarifies :-

‘unreasonable’ relates to the request for 10 years of Minutes – these can be obtained via the Archives at County Hall".

We feel think that DPC have interpreted our request incorrectly. We have NOT requested last 10 years of DPC minutes. We have been clear that we ONLY require documents relating to the 4 trees (see attached - tree location highlighted).

Our FOI request is -
(1) Copies of all tree reports, surveys and DPC minutes that relates to the monitoring, maintenance of the two trees that are in questions next to our property (8 Raffin Close) over the last 10 years.
(2) Copies of the tree report, surveys, DPC minutes and all other communication of the two trees next to 6 Raffin close on DCP land. These have been trimmed back by the council and we would like to understand why they’ve chosen to maintain only these 2 trees.
(3) A copy of the tree report, surveys, DPC minutes and all other communication of the two trees in front of 10A Raffin close. They were trimmed back in last couple of months, as part of your winter trees maintenance schedule.

I am writing to acknowledge your written request for information.

Your request is being considered and you will receive the information requested within the statutory timescale of 20 working days as defined by the Environmental Information Regulations, subject to the information not being exempt or containing reference to a third party.

Thank you for your request for information, this has now been processed and the information that we hold is enclosed.

Our FOI request is -

East Herts Council does not hold copies of any Datchworth Parish Council (DPC) records nor has it advised DPC in relation to its duties under the Freedom of Information Act.  East Herts Council would not withhold any maintenance records that it might have in relation to individual trees growing on its own land but cannot advise how time consuming it might be for DPC to do so in relation to trees on its land.

East Herts Council has not commissioned any reports or surveys in relation to trees next to 8 Raffin Close, 6 Raffin Close or 10A Raffin Close and would note that the land upon which these trees are growing is not owned by East Herts Council.

Records relating to the administration of any Tree Preservation Orders in this area are available on request but, for clarity, do not include any of the documents referred to in this request.
